Student Loan Discharge Has Become Easier
Most People — and Even Most Lawyers — Still Don’t Know This Is an Option
For years, borrowers were told you couldn’t discharge student loans in bankruptcy. That was never entirely true, but now, under new guidelines from the U.S. Department of Justice, discharging federal student loans through bankruptcy is a real possibility.
Yet very few attorneys — even nationally — are involved in this work. Many still tell people, incorrectly, that it can’t be done. That’s why I’ve decided to offer this service: because too many borrowers are being given the wrong advice, left confused, and losing hope. I recently was before a Federal Judge who asked why other attorneys don't bring these student loan discharge proceedings. That had a profound impact on me at the time, and after May 5, 2025, when the new administration ordered student loan collections to resume, along with interest. Well, that was just too much for me to swallow, and the calls started coming in from all over the nation.

The government’s so-called “income-driven repayment plans” stretch over 20 or 25 years. That’s two decades (or more) of uncertainty, interest, and anxiety — and there’s no guarantee of forgiveness at the end.

I’ve practiced bankruptcy law since 1988. I’ve helped thousands of people wipe out overwhelming debt. However, in the past few years, I’ve received numerous calls from individuals overwhelmed by student loans and struggling to find help, even from other lawyers.
The Department of Justice is no longer taking a hardline collection approach in every case. In fact, they’ve opened the door to relief. But almost no one is walking through that door — because they don’t know it’s there.
So I’ve added student loan discharge to my practice — because the need is overwhelming, the process is real, and people are suffering unnecessarily.
